Abusive husband demanding dowry not ready to give divorce

Got married in 2012, after 3 months we separated he was abusing me and parents for money reason (Farmer family-i dint have oroof ti prove his offence) he told me not go bck to his house but me & my father went there house . They did not respect us only.again i went alone to his house he didnt open the door only after 20-30 mints.he opened and i asked him his decision he told want to divorce then i took my things. And they took all there things what all they given me in marriage. And they never responded to my or my parents call not even have concern to come n talk now they are coming back saying stay or divorce him that to without going court . But i wanted as per the rules to get divorce but they are not ready come court because they have to pay compansation i am not working now and not getting any support from parents also how do i go ahead with this ? i dont have my marriage photo they only taken responsibility of marriage we payed money to them. please advice me.

you can file for divorce and also seek compensation. you must be having the invitation card or the marriage certificate. Even if you do not have them file the petition and state in your petition that the marriage certificate and photographs are with your husband.

You can also file for domestic violence case and seek for maintenance from your husband.

You are being left over by husband and family in a very good and technical way and creating ground of desersion ,what I suggest is either your lawer not enough smart or you are not making good effort ,I better suggest that you can come with all your case documents and any other documents that you have so that we can help you at earliest as per Law.....OFC : pankaj Kumar ,Advocate

As a first step you file a criminal case for causing mental torture and abusing you. Thereafter file a Domestic Violence case against your husband. Simultaneously you can file a contesting Divorce petition making your husband as opposite party. Then you can expect some sort of monetary compensation from your husband.

You can file a suit for divorce and maintenance. You can also take action u/s sec 498 A IPC for harassment by husband and in-laws. There are a lot of things we need to know regarding your case. Please feel free to contact for further advise.
