What to do when web developer is not handing over the website file?

we hired a web developer in 2015 for which he made a website & since then has been charging AMC & any small uploading charges too. His contract expired in April 2017 & we further do not wish to continue. So he says we need to pay AMC charges till September. Whereas we have not mentioned for renewal. We asked him to handover the file but he refuses to it, for which we have paid in 2015.

First of all you have not mentioned whether a written contract was executed between u and the web developer and if it is there than only after going through the contents of the contract document it can be ascertained whether he is charging you as per the terms of contract or otherwise. But if you find yourself cheated you can file a criminal complaint against the web developer u/s 405 for criminal breach of trust.
