Is installing spy software a crime is it admissible in court

I have installed a spy software in her mobile. Because of which the truth came out that she had an affair before marriage for 2 years. and after marriage also they have met and went to a tourist location for 2-3 days. Now she wants to marry him as he is calling her back and telling her that he will marry her. To make things easier she is planning to create a false picture of harassment done by me. Evidences are whatsapp conversation recorded and phone calls made to her home recorded. My question is, 1) Can I produce these evidences in the court ? 2) Will it be treated as a cyber crime ? I am just trying to defend myself from the allegations as the laws are in favor of women. But why is this treated as a cyber crime if there is no misuse and it is not used to threaten anyone.(If it is a crime) 3) What are my chances of not getting into a new trouble of cyber crime (3yrs jail and upto 5lac fine) while trying to get myself out of dowry,498, alimony, maintenance cases. WHat should I do?
