Filing of late charge sheet. What are the options that can be used .

Can police take 1 yr to file chargesheet in cyber crime case(fake accnt)? And late cs can be in favour of accused?? Can complainant be in trouble if she allegally make me accuse and police wont found any evidence against me? Does complainant have the right to defame the me(accuse) via newspaper and spread ill messages against me on whatsapp and similar messaging services and frnds after the fir is filed though the accused is not even convicted. And can police present false evidence against me by taking bribe from complainnt?

Legally police should file a case within specified time. but they always seek for the time limit exemption from court and court grants it. favor of case will be depend on the evidence police have gathered. And definitely complainant, police are not allowed to defame accused as the crime is not proved. You can complaint at court/senior police officer for such defaming and threatening action. Police can gather evidence from ISP provider, Facebook or Whatsapp and cannot modify the evidence as it must be tamper proof. So in cyber cases, you do not need to worry about fake evidence as it can be challenged by accused and court.

The question which u have posted are purely technical.
Firstly there is no time limit to file chargesheet in court
Instead there is a minimum time limit but which they have to file if not then they can take their own time.
Secondly filing a report stating that they have not found any evidence against accused is a matter of consideration before judge he can either accept it or reject it. If accepted then u have a option to file complaint for defamation and compensation.
