Can I file a case against someone discreetly selling sex toys online?
05-Nov-2023 (In Cyber Crime Law)
I was hired by an online store for taking care of their database. I had no knowledge about the product line till I started working with them. I have worked for them for 3 months and come to know that they sell sex toys online. The products are properly packed so that no one can make out the real content. Now they have started posting pictures of the toys online and sell them discreetly. Can their act be booked under IPC? If yes, do I need to inform the cyber cell first?
There is no express rule in India to prevent sale of sex toys, but there is another aspect. Any trade which is against public morality can be banned by the government.
What you are trying to do may be held against public morality. The best way would be to sell it through a website, which should be discreet. The pictures of the product should not be displayed nor should there be any statement or expression which could be interpreted as immoral.
