Can I import airsoft rifle what is the procedure for the same?

02-Mar-2023 (In Customs & Central Excise Law)

I would like to import one airsoft rifle and one airsoft pistol into kolkata from a store in hong kong. Airsoft rifles and pistols fire small 6mm bb plastic balls like the toys children buy from fairs. These are essentially the same things but the weapons are made of metal, they are toys,i should point out, they are not real weapons. So my question is how do I do it?

Even though airsoft in India is allowed, there are still a lot of legal hurdles to be crossed to acquire them especially if they are metal finished, due to non-awareness among customs officials. Pellet gas guns can be ordered online through various websites but one has to be a member of any officially recognized Rifle Club to procure it.                                                                                                                                                           The legality of airsoft in India is summarized below.
"The customs act does not mention imitation firearms anywhere. None of its sections apply to airsoft, especially electric powered airsoft guns. Also, airsoft will not come under any other category above due to it being not "Arms", but it is not explicitly mentioned anywhere in the exim policy or act. The words 'airsoft' or 'toy gun' appears nowhere in Customs Act. So, it can be a toy, hobby item, firearm, imitation, or even blank depending on the opinion of customs official in charge of the day. i.e.unpredictable import scenario. Arms act comes into play with airsoft only when you break the "certain cases" clause relating to abuse of imitation firearms. And it's the exim policy that decides if you are eligible to receive it or not. If and when airsoft guns(6mm bb guns) are detained at Indian customs, it will be sent to the nearest forensics lab to "certify" that it is not a firearm & that it does not come under the purview of its Arms act. This will be done for every detained parcel regardless of previous instances at the same facility. In a nutshell, any kind of interaction with airsoft in India can be as dangerous as dealing with firearms due to ignorance of government & general public hence it is advised to get in touch with the custom officers for further clarity.
