When will appeal get numbered and admitted

04-May-2023 (In Criminal Law)
Your honour, mycase is matrimonial (hindu) issue where 498a acquitted by lower court and 406 fined as sentence. Against post conviction on 406 ipc, I applied appeal with condone delay and order was passed dated 12 apr 2017 stating rs.1000 cost to be paid to legal aid on or before 27.6.2017 then petition will be allowed else automatically petition dismissable. Cost paid and memo for paid cost filed to court by counsel. My question is 1. When and How appeal will be numbered on what date? 2. Why so much 2 1/4 month for allowing appeal petition? ( even my advocate astonish) 3. Whether on 27.6.2017 the appeal will be admitted automatically and what will be the duration for appeal completion approximately since I have to join professor job if criminal history exist I cannot do professor job on basis of professional ethics? I asked my adv only says wait hence I am asking above question.

The high court normally in those days allows such kind of practice that impose legal costs and given much more time to pay in section 5 application in criminal appeal. On 27/6/17 condone delay allowed after that appeal will be number in 2 or 3 days after 3 days it is sorted for admission and after admission ordered notice to prosecution and after appearance of prosecution the court order for call for records and after that the appeal will be finally decided by consent of both parties and mostly as per wishes of concerned judge. Since there is only fine imposed on you by lower court not imprisonment means there is no legal bar for your job and you see court process is a very long and you believe in your advocate

It is process of the court and you have to adhere to it, if the court mentions a particular date, it will be listed and other side will be called upon to hear their side, since it happens to be appeal it may not last long.I hope things will end at the earliest. So hold your breath for the time being.
