What will be punishment in section 3(1)(x) ? Please guide ?

My brother is a government employee and he is facing a false case by a public at his working place.. The case was lodged under sc/st act and charge section is 3(1)(x) for calling a particular caste by name i.e. "chamar".. So what punishment will he get in case he couldn't prove the truth of not calling so?

If you feel that that you are implicated in a false case you have the option of raising the issue in high court and get the FIR quashed. I dont knkw the stage of your case. But please be noted that it can be quashed at cognizance stage too. Pls contact for more consultation.

your brother needs to go for appeal along with anticipatory bail, firstly from the special judge, lower court and then approach the high court, as appeals are filed in sc/st act cases. new provisions of the act have been amended which is more strict in accordance and the accused needs to proof of his/her innocence. kindly without delay, go for the anticipatory bail as the law is very strict plus your brother is a government employee.
