What to do in case of of false criminal allegations on my mother

Relations between my mother and tai were estranged after my fathers death due to some family problems. . After that she has sent a fake letter to her office(with false name) and imposed false allegations on her.my mother is a clean government employee, so she was given a clean chit immediately. furiously my mother has written the letter to my cousin sister husband about her previous affairs with a boy. When I came to know about this I and all my maasis scolded her for her childish behaviour then . After that she got so furious that she started threatening her to lose her job. Ultimately ,we were called by the police where police scolded my mother on 19th January,2017 and leave her after giving her warning(as it was simple case of tensions between two sister in laws). But on 4th February ,police has registed an fir where my tai has accused my mother of abusing her and getting physical on her on the same day of 19th January,2017.Sir, it is a baselessfir she wasduty that day..

You can challenge FIR before high court through criminal writ petition. You can prove previous enmity through various incidents and other documents which you have mentioned. You can for quashing of FIR.

So you need to file a writ petition before honble high court for quashing of the impugned first information report as well as for staying the arrest of your mother alongwith the proof she was on duty on the date the alleged offences occurred.

Well if you have a proof ,that day your mother was on duty then coperate investigation officer if after investigation IO submit FR then good or you can file a writ in U/S 482 CRPC in highcourt to quashing the FIR

In this case you have to go for quashing of fir in highcourt .means file application for quashing of fir under section 482 cr p c . And fight the case on the merit ground and submit that day Attandence record in the office

Hello,

I understand your concern, if you have sufficient evidence in this support then you can challenge it in the high court. You can file a writ for FIR quashing for the same, at least you can get a stay on it.
