Please lodge a police complaint immediately (and give a copy to the concerned school authorities) alleging Section 323 (voluntarily causing hurt) of the Indian Penal Code against the teacher specifically and concerned section of the State law against cruelty to children against the school. Depending upon where is the child studying, select the state law, for instance, UP State Law's Section 23 deals with the same.

You must lodge a complaint in the police station against the School management and the teacher who is regularly beating the child, but first take pictures of the injury spots and then approach to the near by police station of the school. If you can do some exercise then you should gather some more parents whose children have also become a victim of such assault.

If the principal has not taken action despite the complaints you have made, you need to take action both the teacher and the principal. Immediately file a police complaint and provide a copy to the relevant school authorities accusing the teacher of IPC Section 323 which pertains to voluntarily causing hurt, and the school of the pertinent section of State law regarding cruelty to children. The Right to Education act, 2009 also bans corporal punishment explicitly and you can press charges against all the parties involved.

Many parents ask can i sue a teacher for hitting my child? The answer is yes, in India, corporal punishment such as physical discipline by teachers is legally prohibited in schools. This practice violates the child's rights and can result in severe consequences for the teachers and school management. Along with the complaint ensure to take pictures of the child’s abuse, medical report (if any) and testimony of the child to build a robust case.

If you are facing an uphill battle, it’s crucial to hire a criminal lawyer to represent you in the case and learn the best ways to approach the case.
