What is the procedure in a 420 case for how long can a case go on

12-May-2023 (In Criminal Law)
A male friend was arrested on grounds that he had borrowed 1 lakh rupees from a girl and promised marriage. By the time the girl withdrew the complaint an FIR was filed. He was in jail for a week and was released on bail. What will be the next step? Is there a way to fast track the case? He has a job offer from abroad. And hence how long can he take permission to join the job?

Dear Sir,

The proceedings are based on the Charge sheet, which will be filled by the police. But usually it takes about 3 years to complete the case. Or you can file 'B' report in police station and close the issue with police station itself. Else, You can apply for Quashing the case in High court but grounds must be strong. Before suggesting best idea, would like to have a discussion with you.

If Girl withdraw the complaint, then Police will Closure Report before the Court and subsequently he will be acquitted from the case by the Court.

If delay in filing closure report by the police, approach the higher authorities in the Police department.

Question requires the place in which the case is pending for a proper answer, pending case he can join the job, with his advocate filing necessary application once in a while and be present either once in 6 months. if you take initiative, the matter can be finished early, provided the witness comes immediately after service of summons.

every second Saturday is declared as lok- adalath day so you can approach the Honorable court and seek for disposal of the matter before the Lok adalth and you can resolve your dispute with an amicable settlement.
