You question is baithe.Bail is a discretionary relief.it depends on facts of the case.You have not mentioned section under which you have been framed.Nor have you given brief description of facts.Bail not jail is the principle normally Courts Fallow but in case of strict liabilities you have to establish your presumption of innocence.

The procedure and the sections under which the bail has to be filed will depend upon the nature of your case and the sections under which you have been booked. Depending upon the sections under which you have been booked, the bail will be filed before court of metropolitan magistrate or sessions court.
