Punishment for Section 301

Section 301 of the IPC pertains to the act of committing culpable homicide by causing the death of a person other than the person whose death was actually intended. In such a case, the accused is punishable for murder under the doctrine of transfer of malice under Section 301. In the eyes of law, there is no distinction between cases where the death is caused to an intended person or whether it results in the death of an unintended person.
