What has judgment stated first. Since if there is only fine it can be paid and matter is closed but what judgment speaks has to new seen since in 138 negotiable instruments act cheque bounce case you can pay fine amount and close but in penal provisions it is bailable offence it can be done and imprisonment can be escaped.

Hi,
The info. you gave is too little for legal advice. It is purely based on the offence you involved. I think, you can not avoid jail term by paying penalty on criminal offence(particularly on non-compoundable offence).we need to discuss which kind of offence you involved.

You have not mentioned what is the offence for which you are arrested or complaint filed against you. In some petty crimes you will be released after payment of fine and there will be no imprisonment as I said it depends upon the crime you have done and the complaint registered and FIR filed under which section. The benefits of paying fine is for government and you will not get any benefit.
