Want to know the seriousness of the case with IPC 451 and 323 !

05-Apr-2023 (In Criminal Law)
Hi Sir, My mother and father (ex captain in Indian army) were attacked by a person called Girvar singh and the police has imposed the IPC 451 and 323 and submitted the case in the court. I want to know how serious is this case ? If proved guilty, how much punishment we can expect for the criminal in this case ? Or do you think the IPC imposed are very week and criminal will get away with minor punishments.

Section 323 and 451 of IPC are Bailable, meaning thereby that the accused will get out of custody on bail during trial. Moreover, maximum punishment if charges are proved is maximum upto 3 years but as inquired about seriousness of offences, I would like to mention that offences are not serious and if accused is not habitual offender than if proved guilty, in all probability there will be a minor punishment.

These sections i.e 323 and 451of IPC relates to causing hurt and house trespass and are not of a very serious nature. Even if the offense is found proved against the accused, the likely punishment will be one or two years imprisonment and it can't exceed seven years any circumstances.
