Threat to file case for not following insecticide norm in supermarket

14-Mar-2023 (In Criminal Law)

I am the store manager of a supermarket retail. One insecticide legal officer got annoyed on not agreeing to his unreasonable demand of some free on products offer which is not valid. He is putting up a case against me for some insecticide prescribed guidelines not met at the store. He is saying that the store manager and director will be imprisoned immediately after putting it up? How can i save myself from this?

Hi
Giving and taking of bribes is illegal. All the more if the legal officer is threatening to file a false case on the store and its employees. file a complaint with ACB (Anti corruption bureau) immediately.
At the same time, whenever the insecticide officer wants to take samples from the stores, ensure that he follows the procedure properly as stipulated in Insecticides Act 1968
Also please note that there is a due process to be followed
a) first they should collect the samples.(in three parts and in each part both you and the insecticide officer should sign on the sealed sample). they should also issue a receipt for the same.
b) The sample should be sent to regional / central insecticides laboratory as appropriate.
c) THe lab should send their report within 30 days.
d) if at all there is an issue identified with the lab report, then he has to file the same in the court.
e) As a defendant, you can also seek another report from the lab based on reminder of samples.
f) the courts will decide whether there is an issue or not and will ask you to rectify and pay a fine if there is a violation.
We have seen many such black mail and do not be afraid. no body can penalise you if you have not done anything wrong.
