Terminated for government job after lower court convicting me of 498A

Dear sir i was on a govt. Job. After 1 year a case put on me under sec 498a/304b ipc. Lower court aquttal me on 304b but convicted on 498a. Appeal admited in high court by me an now case is pending in HC. Dept has terminated me on this stage. Pls advise any way how i get my govt. Job. Pls help sir.

Dear Sir,
Kindly send me the service rules applicable to your job alongwith the termination letter. It can only be advised after going through the said documents. However, prima facie the said reason cannot be made a ground of termination once the appeal is pending before the High Court.

You can file a writ petition and take your chance before the High Court. Generally administrative orders are separate and apart and independent of any Court orders therefore if the departmental inquiry was held and your services were terminated then your order of termination must be challenged. It can be done on grounds of violation of any of the administrative principles. There have been orders of termination quashed previously under similar circumstances.
