04-Jan-2023 (In Criminal Law)
me accused for 306 ipc in a unsuccessful death of a peerson in 2014. after 2.5 years the person commited suicide without any suicide note ..will the first 306 ip become problem?
Yes,in all probability you may be put in peril of prosecution. But at the same time if the earlier case is only unsuccessful one you will not be held liable for the present occurences only because there was an allegation
Even if prosecution investigation arrived at a conclusion that you are liable for the suicide, they should also prove your acts towards the same which led the person to committ suicide.
Though no note of suicide is there if the circumstances are leading to an inference of your guilt then also you will be held liable ,or els you can be acquitted as that of earlier time.
