even donated or what the gold offered is stolen so the police would claim position and the real owner is entitled to take it back by filing appropriate application under section 457 crpc and where as to the broker would be the witness in proving the crime against the accused

Hello,

Police will definitely question you in order to verify the broker and third party's statements and claims. Chances are there that the court may upon request from the PP can summon you to record your statements and for further examining you at the time of the trial. Therefore, tell the correct facts to the police and help them in their investigation process.

If u don't want to step into the legal problems negotiate with the police and pay money to them inturn, they will purchase the required gold and u will not drag into any legal complications. It is the general procedure every where going on.
