Son harassing mother for money what legal action to take

Good evening sir I have a question for you sir my elder sister is of 70 years of age and her husband has been expired and my sister son is harassing my sister to go and ask money and if we didn't gave his son a he is asking shares after my father that is 40 years so what to do please advice us in this matter that I can do the case in our city under section 498a.

Good evening.
You can file complaint n police station against her son.
You cannot file complaint under section 498A IPC at this stage of life and in this situation.
You can file Domestic Voilence case and under senior citizens act these are the best solutions.
You have no need to give any money to your son. No legal boundation to maintain son.
If she had earned money from her Income or husband's income then she has choice to keep him and his family in home or not.

Your sister's son has no right in ancestral property until his succession open, that means your sister's son can ask his share in property after death of your sister.
Right now he does not have any right in your sister property, as he harassing you and your sister then you can lodge police complaint against him. But not under 498a.

What is the status of the Property, in which your sister's Son is asking Share. No share can be demanded from the property, which is a self acquired property, or the ancestral property that is partitioned before coming in to force of 2005 Amendment Act.

if your sister is in your favor, then you should get a Registered Deed signed from your mother, that she relinquishes all and any right in the fathers property.

498A is not applicable, because here, the person guilty is son and not the in-laws of your sister.
