Sexually harassed by uncle in childhood can the case be filed now

My gf confided to be that when she was in class 2 and was visiting her mother's house her maternal uncle called her to a room laid her on the bed lifted up her frock rubbed his hands over her genetalia and took out his penis and started masterbation followed by ejaculating on her. I have voice recording of her confession. Can I take legal action against him now? Please help

secondly,it is only she who can file the case as she was the victim.
thirdly,if good eyewitnesses or enough evidences are there, you can file a complaint against him.

May be or may not be. The question is how to take action by the Police Authority against said uncle after elapsing so many years. But admittedly it is offence and punishable.
My suggession is to contact with O/C or I/C of Women Cell in the area where your gf resides or offence was committed and narrated everything to him for relief.

In this case my opinion is that she has missed the train. In a criminal case prompt FIR is one of the most important thing. An inordinate delay to filing complaint of any offence is fatal to the prosecution case. At this stage you can not prove the case.
