School does not have affiliation with CBSE and still running

Sir, My brother got admission in 2015 in a school in class IX. Now I came to know, that he can't appear for Class X Board Exam as School was disaffiliated in the year 2013 by CBSE. The School is still running with same affiliation code printed on its official documents. I just want your advice about all legal options available with me to file a legal suit against the school. The School is based in Bihar and can I file a case in Mumbai, as I stay in mumbai.
