require Bail in NDPS when nothing is recovered from the accused

A accused is been arrested in NDPS act where nothing is recovered from him, but the police got 7 days custody, whether he can get bail and can be discharged from the case ? since the family is poor and from outstation, other 2 accused arrested, from them around 90 mld seized, as per the Mumbai High Court if anyone is arrested in NDPS without any recovery can't be arrested.

I need to know the details of the case first. I need to see the FIR and remand applications. Then only further course of action can be decided. Take an appointment. It's not possible to advice you properly without going through the documents.
