Regarding cheating and dowry harassment of sister husband cheated

Dear sir/madam, My sister got married on Feb 2014, after 3 months we came to know all ready he got married and devorsed because of their parents. Even after that he was illegally with his devorsed wife in a separate house from long time. He caught red-handed in Bangalore and we given complaint. We told police to proceed legal process their only. But police took lot of money from them and told us they will transfer case to Mysore. Because of life threat we opposed to transfer. Then didn't put charge sheet for 19months. Then we given complaint in Human Rights. After that they transfers case to Mysore without informing us. Last week only from Mysore police filed charge sheet with out informing us. submitted to court. The police cheated us in all the way. 1 Please let me know what we can do in this case? 2 Before fileing charge sheet, is police need to contact us or not let me know because the hole family cheated us few of their family names missing in chargesheet.

As a rule Police is bound to intimate the Complainant by way of issuing notice before filing the Charge Sheet(Final Investigation Report) to the Magistrate Court. Anyway, you can approach the High Court for the transferring the case to Bangalore since law favours woman i.e., if the Respondent in case of Family case and Complaint in the case of Criminal case is a woman, then for convenience sake the court will transfer the case and further your sister can file a divorce case herein Bangalore, if she wishes, taking advantage of her residence proof.

There is no necessity to file charge sheet without ur consent but they have to call u for further statements to be recorded but not done anyhow u have opportunity to file domestic violence against all of them and file other cases maintenance case harass them

You have to contest the case before court and take your stand by proving your case as on adultery . As police have filed their charge sheet then it is better to proceed further in court by attending your case by keeping in contact with your advocate by providing relevant information about your case and documents. You could have complained against the police to Commissioner and could have filed PCR when they didn't do their duty delinquently didn't you contact any advocate. If you are an resident of Bengaluru then you can move application for transfer of case to Bengaluru in the court. Consult advocate.
