Punishment of year back for cheating in exams. how can we challenge ?

My son was caught copying in his BSc. 3rd Semester exams to which he pleaded guilty. He has been asked to give ALL exams of 3rd Semester again in October next year, AND take a ONE YEAR BREAK from March 2016 to March 2017. I feel this One Year Break order to too harsh and will result in spoiling the child, instead of reforming him, which should be the purpose of punishment. I wish to move the Bombay High Court for appropriate orders.

You may file petition before high court and seek the remedy u/s482 of crpc. Or else first issue a legal notice to the concerned authority and upon failurevthen take a legal steps. It would be advisable that to write a letter if it doesn't work out then issue a legal notice then move to high court.

You could file a Writ before the HIgh Court challenging the order on the grounds of being excessive and arbitrary but it will depend on the facts and circumstances and any rules/regulations that the College will have in that regard. If regulations stipulate the same, then the regulations will have to be challenged. Additionally whether it is a private/govt college will also be important.
