Procedure and requirement to file case for grievous hurt

An autowalla physically hurt me an my brother-in-law yesterday.In addition to the autowalla, two joined him. We complained in HAL police station. We already have the names of accused. My brother-in-law got a bone fracture. My eye was scratched leading to temporary blindness.I want to file a case under section 325 for causing grevious hurt. How and where can i file the case? What proofs should I collect? Is this a bailable offence?

on the report filed by the police, an FIR should have been filed by now. if not filed you me file a complaint in writing in ACP or DCP office, or Commissioner office. if you have no faith on the police you can approach an advocate who will draft a compalint under section 200 of CrPC and file it before the court also.

please ask HAL police to register FIR against them as you already given a complaint, collect all medical records where u have taken treatment. You can also claim suitable compensation by filing MVC case against autowala, be sure that you properly insured n don't miss to collect FIR etc from police.

Yes it is bailable, and it is punishable imprisonment up to 7 years. You can file a complaint before concerned jurisdiction court and send him notice. Consult and file a suit before concerned ciurt . Y out get auto number, his name and address etc., consult and get advice.

Since you approached hal police station, they will enquire with the case and file an fir against them. If they will decline to register an FIR, you can directly file a complaint before the court. 325 is bailable. If it weapon, it becomes 326 and non bailable.

In the jurisdictional police station you gave complaint, jurisdiction Means place where incident take place for that area there is a police station
Send any one on behalf you to give complaint, after complaint given get admitted in the government hospital and get wound certificate and polic take statement unless you are not discharged they will not get bail manage doctors and stay in hospital for month so they are in jail
Once discharged get discharged summary about the injury and hurt if report strong and produce witnesses they will get conviction
