You will have to file a Civil Suit for Recovery of the amount along with the interest. You can also file a Suit for Specific Performance for enforcing the Agreement to transfer the property to you on receiving the remaining amount.

If the other party is not traceable then a Criminal Complaint under Sections 406,420 and 120B shall be filed before the local police station.

You did cot mention whether he was actually owner of the property or not?
First of all lodge a police dd entry and pursue at dcp level to get fir register.
In addition to that file a suit for specific performance.
If police refuse to register fir,you can file Crinan case in court

You can definitely file an FIR. If the FIR is not registered you can contact me for any further action to be taken in respect of Section 156 (3) CrPC.

It is a clear case of cheating and fraud and all facts have to be gathered before proceeding with a complaint. Police will declare the person absconder only when relevant steps are taken to trace him.
