original documents & IN person representation for my case

Dear Sir/Madam, i have query related civil and criminal case 1) i don't have money to hire pvt advocate i did try for legal aid cell and pp but didn't work i want to go ahead as IN PERSON need to understand the process 2) i have give original documents to pvt advocate and she is not giving my original documents kindly reply

First of all what type of matter or case is pending in court -- Civil or Criminal ??

Also in which court this case is pending??

Once these information is shared then it will be easy to guide you on how to proceed or prosecute your case.

The Advocate has to return your documents.

Please send her legal notice to return your documents.

OnCe she receives Legal Notice then she will return your documents.

You can approach the court and explain them your problems and free legal aid is your right and the court can assign a lawyer to you. but going ahead in person is also legal but it will be troublesome for both you and the court of law as you are not a lawyer hence cannot interpret the requisite law to the court and if your private advocate is not giving you the documents then you can request the court via an application and court can obtain the documents by a notice if they are essential to your case. please contact your local lawyer for further advice.....

Dear Sir/Ma'am,

You can make an application to the Court to represent your case in person. However, if you are the Complainant in the matter, then you can only assist the PP and cannot represent the case in person. Same is not allowed by law. You can represent in person only if you are an accused/Petitioner. If the private advocate has your original documents and not giving them back, kindly write her a letter asking them back and take acknowledgement. She should thereafter give it back. Mention in the letter details of when the matter and original papers were given to her. If she still doesnt, make a complaint to the Court as well as the Bar Council.
