THIS IS GANJA CASE NDPS ACT, cultivation of Ganja plants case. The Accused was arrested and sent for medical examination on 31.5.17. The doctor advised in written for admit in hospital as he suffering with HIV, loose stools, Vomiting... The accused taken in to custody under cover of panchanama @31.5.17 at 1.15PM MY QUESTION IS DOES THE ACCUSED HAS TO BE PRESENT BEFORE THE HONBLE COURT BEFORE 24HRS OF CUSTODY... I.e. by today 1.7.17 by 1.15pm

Technically the accused cannot be sent to jail as his health condition is not permittiing.
However police would have taken permission from the judge to produce before the judge as and when health improves.
