Misrepresentation by person that he is the owner of the flat

We found a guy from online site we wanted a house on rent , we slowed us the flat took advance and also rent amount we asked for the owner but he said owner does not not hindi or engish and I handle of this deals so dont worry. Later when we shifted to the falt we got call from owner he asked us to leave because that guy did not pay any amount to the owner. Now that person is missing what action can we take against him

This cannot be termed as ‘Misrepresentation by person that he is the owner of the flat’ as the agent who showed you the property has told you that the owner does not know hindi or English and he handles the deals. Hence it appears from your query that you were already aware that you are not dealing with the owner. Since you have already shifted, you might have entered into a rental/ lease agreement which was signed by the owner. If you have this agreement, you can tell the owner that you have entered the flat lawfully. If there is no agreement, then please collect all the documents/ sms/ communication that you have exchanged with the broker/ agent to show that you have interacted with him. Also, it is likely that when you paid the advance amount and the rent, you might have the bank receipt/ cheque details or taken some acknowledgement from the agent like his signature. You can furnish these details to the owner. If he asks you to evict from the house, you can file a case but you will need to collect the materials for it.
