Matter has been filed wrongly filed U/s 376, 354 of the IPC.

Sir, i have been falsely implicated under the charge of 354 and 376. As per the complainent, i had visited her office and raped her on 24th and 25th april, 2017. But i was in Haryana on the said dates. My call records and witnesses are testimonies of the fact. Complainanent has already filed two false FIR on other person also. Records are available in the Honble court. Accused has already filed counter FIR on the complainent under Section 156 (3) under section 388 ipc. Complainanent has sent by SMS more than 100 extortion messages to accused which she admitted before the Hon'ble Court. Not only this, she has extorted Rs. 40,000/- from the complainent on 10th May, 2017 and filed FIR on 16th May, 2017 I have got interiem bail from court of around 45 days. Is there any proceduce in the law that if a person has got interiem bail for more than 45 days, he will get permanenent bail Easily. Kindly do the needful

From the given description here in, your case looks strong. There's no such provision as to the duration of bail. However, the main ground for proving rape is the MLR of the victim. If the investigation therein has not recorded your samples, rape is unlikely to have happened.

Interim bail: Anticipatory Bail is filed but police need to investigate the case and court feels that investigation could not be completed soon, court will then release you on interim bail. It is basically a protection given to you and direction to prosecution to no to arrest till further orders. Interim bail can also be allowed in regular bail. i need to talk to you for discussion of fact in detail

Dear client if all the facts you had provided had been admitted by the complainant then you will definetely get regular bail.


But the plea of alibi shall be taken at the earliesr stage

In your case there will be no problem for getting a permanent bail order. But it is not clear under what application you have got interim bail. I am presuming that you have filed an application for Anticipatory Bail and which was allowed. Now you need to regularise your bail, and in your case it will not be difficult.
