Living abroad but called in for testimony for my bike thief's case

24-Aug-2023 (In Criminal Law)
Hi there, In 2015, my motorcycle was stolen from outside my house. I promptly lodged an FIR about it. In the meanwhile, I moved abroad. Now, a couple months ago, my brother received a summon from the court where it said that I must appear as a witness in the court to prosecute the accused thief. I can obviously not appear in the court since I am working abroad and getting leave from work and spending up to 1 lakh on the ticket is not feasible. What should I do to get away with not appearing in the court? Note: The bike is on my mother's name. I just went to file a complaint. The property outside of which the bike was stolen from is on my father's name. I don't know if this is relevant.

if you do not appear, the court will close the right for cross examination, you can also send a letter to the court stating that you have shifted abroad and you cannot come for the court proceedings due to unavoidable circumstances. there is nothing you should be worried about.
