The victim should immediately go to Civil Hospital/Government Hospital for his/her medico legal examination by explaining whole incident to Doctor on duty. The Doctor on duty would do his/her medico legal examination and then sent intimation to concerned police station. After receiving intimation from the Hospital the police personnel would come to hospital to record the statement of the victim. If the victim receives the threat of killing from the accused person then police would definitely prosecute the accused person under sections 323/506 IPC. If there is no threat of killing then the victim can file criminal complaint against the accused under section 323 IPC in court of Judicial Magistrate after procuring his copy of MLR from hospital and copy of DDR from police.

please be informed that in the eyes of law, everybody is equal. No matter he is a relative of MLA or anybody else. You can file a criminal case against him, if you have some proof of the facts, which you are alleging. Nobody can threat or injure anybody.
