16-Feb-2023 (In Criminal Law)
A case of 323 has been decided against me by the judicial magistrate of 1st class and i have been convicted. Now i have applied in sessions court and we want to produce extra evidence. Is it possible?
Offence under sec 323 of ipc is not a serious kind of offence and punishment is for 1 year imprisonment or Rs.1000 fine or both.If any new fact or evidence has come to notice you can any time suring trial submit that evidence by a supplementary affidavit.

Further evidence in Court meaning
No it is not possible as far as session court is concern. You can appeal for acquittal in sessions court but you can only produce extra evidence in the trial court and not in sessions court. Still go for an appeal in sessions court as well as high court.
