Is getting stay in offences under section 304b.498 possible?

Is it possible to get Criminal Stay in 304B,498 case in highcourt as the person is not the main accoused ? what happened to Govt servant when in jail for more than 48 hours and got stay on session court decision. the department will continue the suspansion or the employee can continue after getting stay

Yes you have the provisions to get stayed in high Court. When a case is stayed u have the right to work since high Court has stayed proceeding so u r not convicted till disposal of appeal and you can do for work.

What Criminal Stay you are talking about there is no such stay prevails under law. You can apply for anticipatory bail in 498. You have not mentioned the stage of the case ? under 304B IPC speaks about death caused due to burn, so who has burnt the victim ? even if the person is not main accused he may be guilty of being abettor. About government job if you are guilty then you will face the music, until you are not proved as guilty you may be continued.

Depending on the circumstances of the case, it is possible to get a stay on proceedings either before the police or before the court in a case where the offences are punishable by 304 - B and 498 - A of the IPC
