In how many days chargesheet is prepared after FIR is filed

My husband file 494 case in may10 in the court. Then forward the case to the police station and file fir june 10th. and enqury also complet, but police not submit the charge shhet in the court. my dout is how many days to charge sheet submt the police their is the limt time or not? please clear my dout.

There is no time limit for filing of a charge sheet though if an accused is in police custody or in judicial custody he or she is entitle to bail if charge sheet is not filed within 60 or 90 days under 167 Cr.P.C.

Make a prayer to HC for speedy trial to direct the session court to dispose the matter within 6 months from the day of the order. Right to speedy trial and Right to speedy justice are guaranteed by Article 21 – A fundamental right.

The said right is not one way. The Madras High Court, Hon’ble Justice P. Devadas stated recently that “Equally, the victim is also entitled to have similar right. The victim, de facto complainant is entitled to know the result of the case given by him. So also, the dejure complainant/police/prosecution. The quick disposal of a Criminal case has the twin benefit of a guilty being punished or appropriately dealt quickly and an innocent is freed quickly.” In Crl.O.P.No.6494/2016

whether any arrest is made or any 41A notice issued usually there is no time limit for enquiry and if any arrest is made you can count on 90 days from the date of remand or else you can file petition before the concern court for bail firstly under section 438 crpc for evading arrest and you can wait for them to file charge sheet. please see that if any cases are pending before you and your husband

There no time limit prescribed but u can file in high Court for direction to file charge sheet and complete the investigation . I can help with getting the order
