If you both fail to prove guillt against each other then you may be acquitted by the court then there will be no quetion of jail or penalty.
So far way out is concern ssud matter it can be decided after studying police paper

Dear Sir,
With reference to your queries following are the suggestion:
1. if you plead guilty you will be convicted and send to jail.
2. or in case if you plead not guilty then you have to prove that you have not committed any crime and you have falsely implicated in the case then you will be acquitted.
