Husband's client trying to harass and lodging false complaint, advise

Off late my husband got summon from a court of judicial Magistrate regarding IPC 497 as one of my husband's patient has filed a petition that my husband has been into sexual relationship with her wife, who is also a patient of him without her husband's consent. My husband is a govt. Medical Officer and there is a chamber in our residence. The matter is completely fabricated to defame my husband. The wife used to call my husband without any reason and may be tapped some conversation without my husband's consent. What can we do ? Please advice.

If your husband received Summon from court then he is bound to appear before that Magistrate, otherwise, Warrant of Arrest may be issued against your husband. If, once W/A issued then as a consequence he may be arrested by police. Please, contact with a lawyer and consult him immediately. He will guide you properly how your husband defend the allegation.

You are requested to meet a lawyer immediately and discuss in the detail without any furthger delay to defend your case properly so that you can obtain relief to the best. Moreover, the summon that you have received you are requested to carry the same alongwith you to the lawyer you meet for him to guide the best.

Firstly, get appear before the Learned Court. Be yourself clean. Appear before the Court with a clean hand. Take bail from the appropriate Court where matter is pending. Cooperate with the police in the investigation. Appear in Court. You will be free from any encumbrances.

MY OPINION THAT i have follow through your submission, & i suggest, your husband is a professional personality ,as well as a Govt. employee, so according to Govt. professional rules & guideline ,it is very much dangerous issue at legal base,you have so many legal ways to escape.

Do appear for the summons on the said date with your advocate your Husband has just been summoned and as such that does not prove guilt. At the same time you as a couple should go and file a counter FIR against the petitioner to safeguard your interests on the basis of threats received and extortion under section 389 IPC Putting a person in fear of accusation of offence, in order to commit extortion.
