13-Aug-2023 (In Criminal Law)
I am working as a software engineer and my brother was staying in native and suddenly he absconded , people were claiming that they have loaned some money to my brother meanwhile in b/w IP notice served to some of them by court, after this, some people in native started filling fake case including me and my father in that and threatening us by using police . We have been taken direction "Not to Harass" from high court and we are planning to go to native, but suspecting that those people will try to file some false cases against us like "we are beating or trying tokill " kind ? how to end this

If you are apprehending arrest pursuant to a complaint or FIR lodged in your home town, then it would be best if you approached the Sessions Court for anticipatory bail. In addition to such protection from arrest, if the case filed against you or your relatives is completely baseless, you could file for quashing the FIR under Section 482 CRPC before the concerned High Court. Thereafter, you may also file complaints for malicious prosecution against the persons who have filed false complaints against you.

They file fake cases and you got order from high court. it is difficult to answer apprehensions and assumptions, so visit you place they may not do anything, because if they try to do some thing and police fail to protect you, you can escalate the same to high court for contempt. so carry on with your schedule.
