How to file petition without hiring an advocate

02-Feb-2023 (In Criminal Law)
Dear Sir/ Madam, Offence related to cheating, extortion, voluntary hurt, house trespass, harassment and blackmail.Local Police refused to register FIR,immediately went to the commissioner of police, same thing happend. So now i decided to make a private compliant under mentioned sections @ crpc 200 / 156(3),to "The Honorable Magistrate". Local advocates are very expensive junior advocate cost 10000 and senior advocate cost 15000 rupess to file private petition, which i can't afford. My doubt: As a citizen, directly im allowed to submit private petition to "The Honorable Magistrate" without hiring advocate? or its compulsary to hire advocate when filing private petition?.Experts please guide me,thanks in advance.. Warm regards GIRI LEO

The petition format is the same as the one filed by an advocate. So you can borrow one and follow the format. Instead of the Advocate’s name and signature at the bottom of the petition and affidavit you just write PETITIONER IN PERSON.

Court fee depends on court to court but it usually is not more than 50–100 bucks depending on the number of annexures you have appended.

Once you have filed a petition without assistance of an advocate, you can still hire an advocate to plead in person when the case is heard. Still its advisable to hire an advocate to draft the pleadings for you because if the petition is not carrying weight, the judge may make up his mind to dismiss it without hearing you out completely.

Hi..
You prepare private complaint and file as party in person in that respective court. Then magistrate will persue you documents and direct for police investigation or he only takes the cognizance .
