How to deal with false rape accusations

Respected sir, This is . There is girl who has filed a false rape case against my relative and police have taken him in jail. Girl told to police that he raped her at 6 am, but at that he was sleeping in his home. He is very poor and feed his family by doing mazdoori. Please help.

Hello.. Based on your information, I don't think he will be getting bailed out by lower court. Ultimately you need to come and consult an advocate in concerned high court.
If police has registered an FIR, then there is no remedy except to get bail and conclude the trail.
Further , it wont be appropriate to come to any conclusion without referring to your case papers.

As for as I concern in a rape case there is no short way to prove innocent your relative will have to face the trial and will have to prove that he is innocent by give the evidence and statment in his fevour but at this time you can file bail application under section 439 of criminal procedure code before the trial court and if trial court rejects the application then you van approach the Hon'ble High Court for bail.
I hope this advice will help you to understand the situation and face the problem.

It can not only be imposed by saying . police may take girl for medical after police complaint it is not easy to just say he is guilty medical report play important role in such cases .And if intercorse with girl is made weather with her will or not
