How can I go abroad after being acquitted under 498A case

12-Jun-2023 (In Criminal Law)
I am a victim of 498a. myself , mother, father and my sister in law were in the case and we all were acquitted in 2011 because of a strong evidence. Now I got separate legally and I am paying the maintenance to the kids. But she is continuously harassing me by lodging a petition that I am not paying or she need enhancement . since 2011 she lodged 4 petitions against me , and now she lodged another petition for enhancement from 3000 to 20000.All the cases which they lodged were false and the magistrate dismissed their petition. My problem is am not able to go abroad or to any job.

from your query it is understood that the the criminal case charged u/s 498 A is dismissed. So you have no impediment to get passport if u dont have a passport u can apply for new one as you are not an accused in any criminal case as of now. If you have a passport you can go abroad at any time. If any petitions are filed against you in future for enhancement of maintenance you can contest it through a lawyer.

sir
you were acuitted of cromnal cahrge of 498 A IPC
your personal presence is not required to defend cases under the domestic vilence act or 125 crpc for maintenance. niehter is your presece required for defending civl litigations .
for tendering evidence you may have to attend the court.
i see no legal impediment in going abroad for work or pleasure.
petition for enhancement of maintnace can e filed when change of circimstances occur. pendnecy of such petition will not in nay wway limit your liberties .
bon voyage
