Girlfriend filed a complaint for denying to marry

26-Aug-2023 (In Criminal Law)
I was in a relationship with a girl for 7 years, our families got aware that we will marry, but due to my gf's behavior i thought the marriage wont work as she used to doubt on me,always crib, dominate and other behavioral issues, since i was living abroad from last 2 years. I refused to marry her and now she has filed case against me in NCW, that i was in physical relations with her on the promise of getting married and now i am not marrying her. Kindly suggest?

You need to hire an able counsel to defend your case. You should present your side of the story to the ncw. If they feel the facts are in your favour they might dispose of the complaint itself. Regards

HI,
IDEALY YOU SHOULD SETTLE THIS MATTER OR THESE TYPE OF COMPLAINTS LEADS TO FIR THAT TOO UNDER SECTION 376 FOR RAPE
FURTHER DELHI HIGH COURT HAS RECENTLY HELD

"If a fully grown up lady consents to the act of sexual intercourse on a promise to marry and continues to indulge in such activity for long, it is an act of promiscuity on her part and not an act induced by misconception of fact. ‘X’ is not believed to allow the appellant to have physical relations repeatedly without first ensuring authenticity of the alleged promise to marriage particularly when they both were married"

Before anything else, ou will need to move for bail before the sessions court to be on the safer side. Thereafter, as the trial ensues you'll have to set up your defense as to whatever happened was consensual and nothing apart from that.

He viewpoint is correct, and if her allegations be taken then the same amount to cheating. She even will try to bring the said case within "Rape".
However, you may prove your point to be correct at the time of trial. Till that time, you may file an anticipatory Bail in case of your arrest.
As far as NCW is concerned, you have to present your case very strongly, as it may direct the police to register the case, and at that time it may prove to be a little painful for you.

Hi, at this stage I advice you to engage an advocate. You may also need to take anticipatory bail. You are saying that your family was also aware of your relationship with that girl. She may also lodge complaint against your parents. I may also suggest you to reconcile the things if there is a possibility between you and girl. Moreover my services are open to protect the people like you.
