I m residing in a govt. quarter for being an employee of the Central govt., my wife is not willing to stay with me other than kolkata,( I am purchasing a flat in a Bolpur to reside after my retirement, I have a house near Bolpur, my native place which is in the name of my mother, father expired) and telling me that she would not vacate the quarter even after 8 months of my retirement, forcefully. I have one daughter unmarried studying in B.a. and son studying in class 12, can she claim to reside at Kolkata only even after retirement? Tell me the way of action needs to be taken by me under the circumstances. thanks

U have not stated clearly whether ur wife is not willing to stay in any place other than calcutta bcoz of some in differences amongst ur selves. If that is so try to convince her by urself and by ur children. . If it doesn't work all of ur stay together and keep ur bolpur flat under lock n key so and give ur some time to settle down or understand the issues on her own without forcing her to so so. According to me its wise on ur part to initiate any legal agnst her and as such since legal agnst her as per law.

MY OPINION THAT according to law you can not hold your Govt. quarter, after your retirement, it is statute, it is completely internal matters of you that you decide finally, according your own choice, and present impotency , first you try to negotiate with your wife, if it out of your control then think about proper legal help otherwise, contact with me.
