Falsely accused in 420 case what is the legal remedy now

20-Feb-2023 (In Criminal Law)
Hi, Few months back my mother gave an affadavit to some 10 members of her kameti group to give their due payment in monthly part payments. Now due to unavailability to that much money. They have lodged an FIR stating we all family members used to run the kameti business and used to go at their place and on the day of signing of affadavit we all were present that time and thus police have made all us as prime accused on 420 &120b charges Now the point me, father & brother don't know them and have never visited their place(can put my office attendence as proof) Please let me know what should be the immediate action for 3 of us? Should we file anticipatory bail or put a complaint that we are being falsely accused or anything else? We are fine with mother as prime accused as we will have to fight this hard time anyhow. But if all of us are put together in the jail or in the case and nobody is their to took care for all of us.

Hi
First of all u all should go for anticipatory bail application. As I observed prima facie other then ur mother, u both will get anticipatory. If ur mother will not get then we will apply for regular bail but what will be the degree of case, I can say after going through copy of FIR.
Feel free to contact me.
All the very best

Dear Client,

i advise you to file anticipatory bail so that you can concentrate on collecting evidences for your case. You are absolutely right that if all of you will be in jail then things (investigation) can be worst for you.

for further information/clarification you can call/meet me.

regards
