False case filed on nick name can go for anticipatory bail

Someone file false case on my friend under section 379/34 ,but as he doesn' t know exact name,so he file case on his nick name,which even neighbours doesn' t know,but in court notice his father name is right,so whether he should go for anticipatory bail or not.

yes ! he should file anticipatory bail
informant has denoted your name in FIR on his best belief ,even if it is wrong the same will be corrected on latter stage.
you are advised to move before sessions court for grant of anticipatory bail....

Yes, he may go for ancipatory bail with a plea that he is not the person against whom the case has been filed, but in this case test identification period is necessary regarding identifiable of the person.

You should go for anticpatory bail immediately.. mention of any details to link you is for the purposes of identification... . it is a matter of trial as to whether the nick name belongs to you or not.

IF NICK NAME IS THERE ALONG WITH CORRECT FATHER NAME ALL G WITH ADDRESS THEN YOUR FRIEND SHOULD FILE ABP BEFORE THE APPROPRIATE COURT AND ONLY DUE TO NICK IS THERE YOU FRIEND SHOULD NOT IGNORE THE SITUATION
