False case filed by wife what can I do

sir my wife and their family raised a FIR of 420 and 494 case against me, my father, mother and younger unmarried sister. which is false complain. can i go to district or high court for stay on this and for anticipatory bail. what is the procedure for this and how can i save my family, please help me.

U should be file a FIR qresh writ in high Court because anticipatory Bail is not grant now by Court. U can submit your relatives affidavit for prof. U should be file a cross complaint.

Yes you should immediately challenge the FIR at High Court in writ petition. Anticipatory bail is not applicable in Uttar Pradesh however in rest of states it is applicable. However you should opt for arrest stay during the pendency of the investigation. And if chargesheet has been filed you may challenge the same at high court in 482 crpc petition.

Yes you can approach the High Court as there is a legal remedy available against false and fabricated FIR's wherein you can obtain an order for arrest stay in case you are in Uttar Pradesh where there is no provision for Anticipatory Bail, whereas in other states you can approach the appropriate forum for anticipatory bail.

First and foremost you should prefer an Application for Anticipatory Bail under Section 438 of CrPC before the District & Sessions Court. You should file the Application for Anticipatory Bail in the light of the Judgment (Arnesh Kumar v. State of Bihar). One you are granted Anticipatory bail you should prefer quashing petition under Section 482 of CrPC.
