False 498A and 304B dowry case after wife's suicide

My married life was very good without single problem and suddenly on one day my wife did suicide when I was in office and my in laws put false dowry case 304B&498A against me & my parents. I was in Jail for one month and after that I had checked her call &sms log,then there were some outgoing long duration calls & late night SMS with one person one day before her suicide and also so many SMSs to that person earlier. How to get SMScontent exchanged by them which are deleted in her mobile. Police said they wont investigate in that way. Please help me how to proceed &come out from false case?
You will need to file an application under Section 156(3) CrPC before a magistrate to have an FIR lodged and an investigation conducted. The Call Detail Records can only be obtained from the service provider through a warrant.
