Fake 498A case, No charge sheet filed yet by police, what can be done

Once FIR filed it's fake Case to be decided by Court but the police has to file charge sheet within 6months unless special reason is shown with prior permission of the court
If police do not have sufficient evidence they will file B report so the Case will be dismissed

Question: There is a case filed against me regarding fake 498a, its been 4 months and still charge sheet is not filled by police.i am struggling very hard and my parents are ill and cant take up this sword hanging on our head.how can we proceed? can we get B-report from Police if they have no evidence for this case?

The police can file B report, however , on the basis of the statement of the complainant and others there is little chance of filing B report. if there is no proof you can also file a criminal petition under section 482 for stay and quashing of the said FIR

Hi, Are you out on regular bail now?. By this time police should have filed charge sheet in court. But they may file it with delay due to delay in getting evidence statement from witnesses. 'B' report can be filed in court only when there is no enough proof against you. you may approach a lawyer to proceeded.

already filed 498a case and u have to wait still file the charge sheet becous police have to file chargesheet (final report) within 90 days and if there is no evidence in your case than police will file b report .thankyu
