Dowry & mental harassment

Hindu My husband n in laws family, wants divorce by keeping all my dowry articles, gold n other belongings. Also they have thrown me out of their home. Now m living with my parents. I want to go back there. What and how should i do ?

You need to teach a lesson to your husband and in laws before going there. If you will directly go there without taking any action , they will not give respect to you. You need to take a soft step to teach them a lesson. You just give a complaint to your concerned Women Cell . They will call your husband and in laws and teach them a preliminary lesson and they have the right to register an F.I.R and arrest, if required at later stage. Then they will give assurance to the women cell that they will not harass you any more .
Harsh Step is that you can file case of Domestic violence and many other steps are there.

All criminal laws are made to protect women from this situation. You need to consult your nearest Advocate and file complaint against your in-laws/husband. The remedies available with you are

a) Maintenance application u/s 125 CrPC
b) Domestic Violence petition
c) Complaint to police wherein police shall get FIR registered if they fail to settle the dispute.
d) Divorce petition

You have several options to get yourself redressed from the arisen situation. You have right to file section 9 petition under Hindu Marriage Act, besides lodging complaint with women cell of your concerned area while mentioning relevant facts of your case and they may call your husband and other family members and certainly through counselling they may be able to get you back in family, else, you may further take action against them and get back your dowry articles through women cell itself, and also seek maintenance through court process.
